Für die Argumentation von Moralphilosophen, die die Legalisierung der aktiven Sterbehilfe befürworten, spielt das Autonomieprinzip eine wichtige Rolle. Ihrer Auffassung nach verlangt der Respekt vor der Autonomie, die Entscheidung eines schwer kranken Menschen gegen die Fortsetzung des Lebens vorbehaltlos anzuerkennen. Dagegen haben verschiedene Theoretiker auf Gefahren hingewiesen, die die rechtliche Zulassung der Tötung auf Verlangen für die individuelle Autonomie mit sich bringt. Sobald der Kranke über die Möglichkeit der aktiven Sterbehilfe verfüge, falle ihm die Verantwortung für die Inanspruchnahme von Pflegeleistungen (...) zu. In der Folge könne u. a. von Seiten der Familie die Forderung an ihn gestellt werden, den vom Gesetzgeber eröffneten Ausweg zu nutzen und sie von der Last seiner Pflege zu befreien. Die Bedenken erscheinen insofern berechtigt, als Formen sozialen Zwangs vorstellbar sind, die eine freie Entscheidung des Patienten verhindern. Allerdings vermag weder das Verbot noch die Zulassung der aktiven Sterbehilfe eine autonome Entscheidung aller Individuen zu gewährleisten. Die Abwägung der Risiken, mit denen beide Optionen behaftet sind, spricht im Ergebnis für die Legalisierung der Tötung auf Verlangen. (shrink)

Am 1. Februar 2010 ist das Gendiagnostikgesetz (GenDG) in Kraft getreten. Die Debatte um einige Regelungsbereiche, wie beispielsweise das Neugeborenenscreening, reißt nicht ab. Ein Aspekt des Gesetzes ist im Rahmen der Debatte um die Präimplantationsdiagnostik (PID) in Deutschland unter neuen Vorzeichen zu diskutieren: Das – international bislang einzigartige – Verbot der pränatalen Diagnostik so genannter spätmanifestierender Erkrankungen, die erst nach der Vollendung des 18. Lebensjahres ausbrechen. In diesem Beitrag möchten wir Hinweise zur differenzierten Diskussion dieser in § 15(2) GenDG bestimmten (...) Verbotsnorm liefern. Obgleich Argumente, insbesondere das Recht auf Nichtwissen des geborenen Kindes, für ein solches Verbot sprechen, kommen wir aufgrund der medizinischen Sachlage und nach einer Analyse der Pro- und Kontraargumente aus ethischer und rechtlicher Sicht zu dem Schluss, dass ein generelles Verbot der pränatalen Diagnostik spätmanifestierender Erkrankungen im Sinne der Zielsetzung womöglich insuffizient ist sowie in der Begründung Inkonsistenzen zum bereits bestehenden Regelwerk aufweist, und lenken daher den Blick auf unter Umständen bessere Alternativen. Die prospektive Analyse der ethischen Implikationen medizinisch-technischer Innovationen läuft immer auch Gefahr, sich in den Wunschbildern von Marketingexperten zu verfangen. Vor diesem Hintergrund könnte es durchaus nützlich sein, die Erkenntnisse der Wissenschafts- und Technikforschung zur Genese und Entwicklung neuer Techniken auszuschöpfen. Dies erscheint gerade auch für die ins Phantastische weisende Zukunft der Individualisierung medikamentöser Therapie, wie man ihr häufig in der Beschreibung pharmakogenetischer Behandlungskonzepte begegnet, angebracht. Techniken, die sich noch im Entwicklungsstadium befinden und deren breite Anwendung noch einige Jahre auf (...) sich warten lassen wird, sollten sehr sorgfältig auf ihren Realitätsgehalt und das zu erwartende Leistungspotenzial hin analysiert werden. Dazu gehört v. a. auch eine kritische Auseinandersetzung mit den Leitbildern, Visionen und Nutzenversprechen, mit denen technische Innovationen oft sehr absichtsvoll ausgestattet werden. Wird dabei die Distanz zur Rhetorik der Protagonisten der neuen Techniken nicht gewahrt, gerät die ethische Reflexion unvermittelt in die Rolle, profane Marketingstrategien wortgewandt und ideenreich zu veredeln. Ist es moralisch verantwortbar, Menschen mit technischen Eingriffen zu verbessern? Der Aufsatz versucht diese Frage zu beantworten, indem zwei Gefahren für Verbesserungswillige beleuchtet werden: der Verlust der Menschlichkeit und der unerwünschte Wandel der individuellen Persönlichkeit. Sodann wird ein „Liberalismus mit Auffangnetz“ als Lösung des Problems vorgestellt, die eine unterschiedliche Bewertung von reversiblen und irreversiblen Eingriffen vornimmt. Im letzten Schritt wird überprüft, wie weit diese Konzeption auch anwendbar ist, wenn Eltern ihre Kinder verbessern lassen wollen, also ein „informed consent“ nicht vorausgesetzt (...) werden kann. Dabei werden Argumente zurückgewiesen, die Habermas gegen eine Verbesserung von Kindern vorgebracht hat. (shrink)

Patientenmobilität und grenzüberschreitende Gesundheitsversorgung sind alltägliche Phänomene in der Europäischen Union (EU). Im Jahr 2011 hat die EU eine Richtlinie erlassen, um in diesem Kontext Rechtssicherheit herzustellen. Bisher gibt es keine umfassenden systematischen Studien über ethische Aspekte grenzübergreifender Gesundheitsversorgung. In dieser Arbeit werden die rechtlichen Entwicklungen der grenzübergreifenden Gesundheitsversorgung dargestellt und die in der Literatur vereinzelt erwähnten ethisch relevanten Aspekte heuristisch und auf Patiententypologien aufbauend systematisch inventarisiert und diskutiert. Es zeigt sich, dass die Möglichkeit der Patientenmobilität und die damit vor (...) allem verbundenen Finanzierungsregelungen die Autonomie einiger Patienten sicherlich verbessern kann. Allerdings können wohl nicht alle Patienten Versorgungsverbesserungen erwarten. Im Gegenteil können sogar negative Konsequenzen für einige Patienten folgen, was vor allem aus gerechtigkeitstheoretischen Überlegungen kritisch zu sehen ist. (shrink)

In addition, there are a number of misconceptions and misconstructions pertaining to the relationship between Radbruch and Kantorowicz in the areas of legal philosophy and legal theory. The article discusses the strong parallels and commonalities between the lives and works of Radbruch and Kantorowicz, clarifies the question of whether and to what extent relativism and trialism form a common neo-Kantianistic basis, (...) and finally investigates whether the Free Law movement served as a common methodological basis for the two scholars. This line of thought found in the journal a possibility of self-expression and it became a real force in the life of the community of scientists and scholars, and even of educated men in general. From the first volume, papers were published which have later been quoted in every discussion about the philosophy of science. I mention, as an example only, R. Carnap's paper on Testability and Meaning. Nobody who has wanted information and stimulation in this modern field of investigation could get it without looking into Malisoff's Philosophy of Science. I present a “reduced” version of the fifteen Pragma-dialectical rules and inquire into their theoretical status as necessary conditions for a critical discussion. Questions: In what respect is PD’s non-sufficiency a deficiency, can and must it be remedied? Brief answers: with respect to defining the concept ‘critical discussion,’ possibly, yes, if, and only if, one seeks to identify the concept ‘critical discussion’; no, if PD is for fallacy-detection.

Using Kohut's seminal paper "Forms and Transformations of Narcissism" as a springboard, Frank Lachmann updates Kohut's proposals for contemporary clinicians. _Transforming Narcissism: Reflections on Empathy, Humor, and Expectations _draws on a wide range of contributions from empirical infant research, psychoanalytic and psychotherapeutic practice, social psychology, and autobiographies of creative artists to expand and modify Kohut's proposition that archaic narcissism is transformed in the course of development or through treatment into empathy, humor, creativity, an acceptance of transience and wisdom. He (...) asserts that empathy, humor, and creativity are not the goals or end products of transformations, but are an intrinsic part of the ongoing therapist-patient dialogue throughout treatment. The transformative process is bidirectional, impacting both patient and therapist, and their affect undergoes transformation - for example from detached to intimate - and narcissism or self-states are transformed secondarily as a consequence of the affective interactions. Meeting or violating expectations of emotional responsivity provides a major pathway for transformation of affect. For beginning therapists, _Transforming Narcissism_ presents an engaging approach to treatment that incorporates the therapeutic action of these transformations, but also leaves room for therapists to develop styles of their own. Purpose: The method of diagnosing diabetic retinopathy (DR) through artificial intelligence (AI)-based systems has been commercially available since 2018. This introduces new ethical challenges with regard to obtaining informed consent from patients. The purpose of this work is to develop a checklist of items to be disclosed when diagnosing DR with AI systems in a primary care setting. -/- Methods: Two systematic literature searches were conducted in PubMed and Web of Science databases: a narrow search focusing on DR and a (...) broad search on general issues of AI-based diagnosis. An ethics content analysis was conducted inductively to extract two features of included publications: (1) novel information content for AI-aided diagnosis and (2) the ethical justification for its disclosure. -/- Results: The narrow search yielded n = 537 records of which n = 4 met the inclusion criteria. The information process was scarcely addressed for primary care setting. The broad search yielded n = 60 records of which n = 11 were included. In total, eight novel elements were identified to be included in the information process for ethical reasons, all of which stem from the technical specifics of medical AI. -/- Conclusions: Implications for the general practitioner are two-fold: First, doctors need to be better informed about the ethical implications of novel technologies and must understand them to properly inform patients. Second, patient's overconfidence or fears can be countered by communicating the risks, limitations, and potential benefits of diagnostic AI systems. If patients accept and are aware of the limitations of AI-aided diagnosis, they increase their chances of being diagnosed and treated in time. (shrink)

In reference to two central concepts of Albert Camus' philosophy, that is, the absurd and the rebellion, this article examines to what extent hisThe Plague is of interest to medical ethics. The interpretation of this novel put forward in this article focuses on the main character of the novel, the physician Dr. Rieux. For Rieux, the plague epidemic, as it is described in the novel, implies an unquestioning commitment to his patients and fellow men. According to Camus this epidemic has (...) to be understood as a symbol of the absurd. Unable to base his actions on a Christian, metaphysical value system, Rieux sees his commitment as a continuous rebellion against the fact of the absurd, which opposes him in the form of evil, suffering and death. As a physician, Rieux is therefore forced to adjust his actions to life in its immediacy, that is, the suffering of his patients. In this article, it will be shown that Rieux's attention to the immediate is of particular interest to medical ethics: Theother person in need, rather thanmy moral convictions, sets the norm. We were not surprised by the opinion piece written for the CambridgeQuarterly by George J. Agich, Ph.D., who chairs the Cleveland Clinic Foundation's bioethics department. Dr. Agich uses the article to attack those who criticized his institution's proposed non-heart-beating organ donor protocol. Because we reported on this controversy for 60Minutes in April 1997, we wanted to set the record straight.

Several recent articles raise an issue long unaddressed in the medical literature: physician compliance with patient or family requests for futile or ineffectice therapy. Although they agree philosophically that such treatment ought not be given, most physicians have followed the course described by Stanley Fiel, in which a young patient dying of cystic fibrosis was accepted “for evaluation” by a transplant center even though he has already passed the threshold of viability as a candidate for a heart-lung transplant. Dr. Fiel (...) reported this action was taken not in the hope of doing the transplant but so that the family could assure themselves they had done “everything possible.” The patient, after a long and stressful cross-country flight, arrived at the hospital in respiratory failure. He died soon thereafter far from home and familiar surroundings. (shrink)

Postural instability marks a prevalent symptom of Parkinson’s disease. It often manifests in increased body sway, which is commonly assessed by tracking the Center of Pressure. Yet, in terms of postural control, the body’s Center of Mass, and not CoP is what is regulated in a gravitational field. The aim of this study was to explore the effect of early- to mid-stage PD on these measures of postural control in response to unpredictable visual perturbations. We investigated three cohorts: 18 patients (...) with early to mid-stage PD [Hoehn & Yahr stage ; 1.94 ± 0.70]; a group of 15 age-matched controls ; and a group of 12 young healthy adults. Participants stood on a force plate to track their CoP, while the movement of their entire body was recorded with a video-based motion tracking system to monitor their CoM. A moving room paradigm was applied through a head-mounted virtual reality headset. The stimulus consisted of a virtual tunnel that stretched in the anterior-posterior direction which either remained static or moved back and forth in an unpredictable fashion.We found differences in mean sway amplitude and mean velocities of CoP and CoM between the groups under both conditions, with higher MSA of CoP and CoM for PD and higher mean velocities of both variables for PD and ECT when compared with YCT. Visual perturbation increased mean CoP velocity in all groups but did not have effects on mean CoM velocity or MSA. While being significantly lower for the young adults, the net effect of visual perturbation on mean CoP velocity was similar between patients with PD and age-matched controls. There was no effect of the visual perturbation on mean CoM velocity for any of the groups.Our simultaneous assessment of CoP and CoM revealed that postural control is reflected differently in CoM and CoP. As the motion of CoM remained mostly unaffected, all groups successfully counteracted the perturbation and maintained their balance. Higher CoP velocity for PD and ECT revealed increased corrective motion needed to achieve this, which however was similar in both groups. Thus, our results suggest increased effort, expressed in CoP velocity, to be an effect of age rather than disease in earlier stages of PD. (shrink)

Die Transformation der Kernphysik aus dem akademischen Labor über die Großforschung hin zum gescheiterten großtechnologischen Projekt war eng verknüpft mit der Implementierung transnationaler Wissensströme. Christian Forstner zeigt am Beispiel Österreichs, wie Industrie, Wissenschaft, Politik und Zivilgesellschaft interagieren müssen, um erfolgreiche Innovation möglich zu machen. Zunächst analysiert er die frühe Radioaktivitätsforschung bis zur Kernspaltung und dem NS-Forschungsverbund Uranverein. Anschließend folgt der Weg von den österreichischen Forschungsreaktoren im Rahmen des US-amerikanischen Atoms for Peace-Programms bis hin zum Bau des Kernkraftwerks Zwentendorf, das nach (...) dem „Nein zu Zwentendorf“ als Ergebnis einer Volksabstimmung im November 1978 nie in Betrieb ging. Der Autor: PD Dr. Christian Forstner ist Physiker und Wissenschaftshistoriker und derzeit Privatdozent für Geschichte der Naturwissenschaften an der Goethe-Universität Frankfurt am Main. Der moderne Rechtsstaat beansprucht, seine Bürger unterschiedslos als freie und gleiche Personen zu behandeln. Aufgrund dieses allgemeinen Anspruchs sind von der Legitimation staatlicher Normen partikulare ethische Konzeptionen ebenso ausgeschlossen wie Willkür und Privilegium. Der Band untersucht das durch die Begriffe Musik, Kultur und Gedächtnis abgesteckte Feld in einer zweifachen Bewegung: Zum einen wird Musik als eine wichtige soziokulturelle Ausdrucksform quer durch alle Kulturen gefasst, ihre Bestimmung und Funktion ändern sich mit den jeweiligen soziokulturellen Kontexten und Praxen. Jedes Musikstück steht in spezifischen kulturell entwickelten Traditionen und Formen, die von ihm aktualisiert werden. Musik wirkt als "gemeinschaftsbildende Macht" (Adorno), als Ausdrucksmittel individueller oder kollektiver Identität. Zum anderen ist den vielfältigen Formen von Musik die mehrfache (...) Verbindung von Musik und Zeit gemeinsam: Die jeweilige musikalische Darbietung oder Reproduktion ist ein zeitlicher Ablauf und als solcher gedächtnishaft organisiert. Die ästhetische Erfahrung von Musik ist konstitutiv auf Gedächtnisleistungen angewiesen und Musik selbst eine temporale Kunstform. Neben dieser elementaren Zeitlichkeit zeigen sich in der Musik aber viele weitere Aspekte subjektiver und sozialer Zeit: die Geschichtlichkeit der einzelnen Stücke bzw. WellsHumboldt State UniversityOver the course of the last decade a fairly large number of Buddhist temples in South Korea have been destroyed or damaged by fire by misguided Christian fundamentalists. More recently, Buddhist statues have been identified as idols, and attacked and (...) decapitated in the name of Jesus. Arrests are hard to effect, as the arsonists and vandals work by stealth of night. In 1998, the Society for Buddhist-Christian Studies announced its support for our Buddhist brothers and sisters and our disgust at such violent misuse of the name of Jesus. At the 1998 Board meeting, an ad hoc committee was set up to explore and develop strategies which would further address the situation. Below are some actions which have occurred during 1999. A Letter from Our President: The following letter of protest was sent on the Society's behalf on January 25, 1999 to the Prime Minister of the Republic of Korea and other governmental officials plus Korean church leaders and organizations. A second letter was sent to the U.S. State Department and the headquarters of various church bodies in the U.S. as well as the National Council of Churches. The Society for Buddhist-Christian Studies wishes to register its deepest sadness and most profound protest regarding the numerous acts of arson and malicious destruction done to Buddhist temples by misinformed and intolerant fundamentalist Christian groups throughout the Republic of South Korea. Professor Frank Tedesco of Sejong University first drew the attention of the Society to these incidents in an article he published in 1997 in Buddhist-Christian Studies, the journal of the Society for Buddhist-Christian Studies. More recently, two more Buddhist temples have been burned by fundamentalist Christians, seven hundred Buddhist images have been decapitated, and the Roman Catholic Cathedral was also burned because it contained images. All members of the Society for Buddhist-Christian Studies, both Christian and Buddhist, are embarrassed that such acts have been done in the name of [End Page 239] Jesus Christ, a name that demands that all persons should live in justice and peace, not sectarian stupidity and religious fanaticism. The small, but vocal, number of fundamentalist Christians in Korea who defend such actions as blows against pagan idolatry are simply wrong. Their actions are contrary to the core of Christian teaching and practice, which is that all persons are to be treated with love, justice, and respect. There is no excuse for intra-religious violence in Buddhist or Christian teaching and practice. Accordingly, the Society for Buddhist-Christian Studies not only deplores fundamentalist Christian attacks against Korean Buddhist temples, images, and persons, we ask that the government of Korea actively seek out all groups and persons engaged in violent actions against our Buddhist brothers and sisters and bring them to justice according to the laws of the Republic of Korea. May the peace at the heart of the Christian tradition and the heart of the Buddha's Dharma heal the minds of the violent so that all human beings may one day live as brothers and sisters in accord and dialogue.
